What are my rights as a worker in Illinois?

What are my basic rights as a worker in Illinois?

All workers 18 or older have the right to a $15 minimum wage; however, employees receive 60% of the minimum wage for jobs where tips are paid.

Workers also have the following rights.

  • Compensation for overtime work
  • 24 hours of rest within every week
  • 20-minute breaks per every 7.5 hour shift and an additional 20 minute break for 12+ hour shifts

What do I need to know about organizing in Illinois?

The Illinois Workers Bill of Rights Amendment guarantees the right to organize and bargain collectively regarding wages, hours, working conditions, and protection of economic welfare. These rights are enforced by the Illinois Department of Labor.

Is Illinois an at-will employment state?

Yes, Illinois is an “employment at-will” state, meaning an employer or employee may terminate the relationship at any time without just reason or cause. If you believe the reason for your termination to be discrimination, you may file a charge of discrimination.

Is Illinois a right-to-work state?

No, Illinois is not a right-to-work state. This means employees may be required to pay a “fair share fee” under collective bargaining agreements regardless of union status. Workers in states without right-to-work laws enjoy higher wages and better benefits than workers in right-to-work states because unions are able to better negotiate on their behalf. 

How do I file a complaint if I’m not in a labor union?

You can file a complaint through labor.illinois.gov. You have the option of submitting the complaint online or to go to a Department of Labor office regardless of union status.
